Asset Recovery Committee

The Asset Recovery Committee, re-launched as an independent committee in 2023, provides an international platform for private and public-sector practitioners, civil society, international and regional organizations, policy makers, experts and funders to meet and discuss best practice and experience in the field of asset tracking and recovery, including asset recovery laws and orders, practical tools and techniques, know-how and case studies, from both criminal and civil law perspectives, across both civil and common law jurisdictions.

US Court of Appeals shakes up overseas forfeiture: due process strikes back

The US government has long relied on civil in rem forfeiture to seize assets linked to crime – even when those assets are overseas. But a recent Ninth Circuit decision has put a major roadblock in its way. This decision appears likely to change whether and how the US government can rely on foreign government action to establish jurisdiction over assets located outside the US.

Crowdfunding in Pakistan

Crowdfunding is the process of raising large amounts of money from a large number of individuals to finance a new project, and it has completely changed the financial industry. Even while it has democratised currency access and disrupted long-standing financing norms, its introduction into developing countries such as Pakistan poses moral, legal and financial challenges, especially with regard to the crucial problem of asset tracing and recovery in the event of a crisis.

The implications of the UK Supreme Court decision in El Husseiny v Invest Bank PSC

This article discusses the recent UK Supreme Court judgment in El-Husseiny v Invest Bank PSC. This was a case in which the appellants sought to restrict the scope of section 423 of the Insolvency Act 1986 (a provision to protect creditors from transactions at an undervalue for the purposes of prejudicing creditors) by seeking a finding that it did not apply when a debtor caused their company to dispose of company assets. After providing some historical context, this article briefly summarises the reasoning of the Supreme Court before discussing some of the implications.

Youth Asset Recovery Club

The Youth Asset Recovery Club is a branch of the Asset Recovery Committee targeting the next generation of asset recovery professionals. While the Asset Recovery Committee is open to members of all ages and at any stage of their career, the Youth Asset Recovery Club is aimed at giving a voice to the younger generation, allowing them to hone their skills in a targeted manner and providing them with a platform to network, as the future leaders in the field. The Youth Asset Recovery Club is actively involved in the events organised by the Asset Recovery Committee, both by contributing to content (e.g. attendance on conference panels) and also by arranging sub-events for the next generation of asset recovery professionals.

The first formal meeting of the Youth Asset Recovery Club will take place on December 4th, from 5:30 pm to 6:30 pm in Riu Plaza España Hotel, during the 2nd Annual IBA Asset Recovery Conference.

The criteria for joining the Youth Asset Recovery Club are the following:

  • Membership of the IBA and the Asset Recovery Committee
  • Professional experience of 15 years or less
