Overreach around the world - recent case studies from around the world, UK, Cyprus, Switzerland & USA
Friday 4 December (1335 - 1435)
Description
Courts and government actors often overreach to limit or restrain efforts to effectively represent victims of fraud and corruption. Courts can often issue procedural and substantive rulings that overreach, intentional or not, that limit the ability to obtain crucial evidence and/or to limit the ability to restrain and repatriate proceeds of fraud and corruption. Other government actors often, well intentioned or not, overreach in a manner that makes it difficult or effectively impossible to obtain recoveries for victims of fraud and corruption. This panel will explore the limits and motivations of this judicial and governmental overreach and how it might be mitigated.
