Mohit Rohatgi

Biography

Mohit is a partner in our dispute resolution practice. With over 10 years of experience, he has gained the reputation of being “extremely professional with very good technical skills” (Benchmark Litigation Asia-Pacific 2021 Rankings). Mohit leads a team of specialist lawyers focusing on high-stake litigations, arbitrations, corporate criminal disputes, and strategic advisory. He represents a wide range of clients across several sectors, including infrastructure, TMT, hotels, and defence. Mohit also has an established counsel practice and argues regularly in the Supreme Court of India, High Courts, NCLT, NCLAT, ATFE (PMLA and FEMA), Special Courts (CBI and ED), etc. Earlier this year, he successfully argued a major Indian financial institution’s plea in a preliminary hearing before the Supreme Court headed by the Chief Justice of India (https://www.business-standard.com/article/companies/sc-notice-to-cbi-on-piramal-capital-housing-finance-plea-to-quash-fir-123022600100_1.html). Mohit’s corporate criminal disputes and white-collar crime practice involves representing clients in domestic and cross-border criminal prosecutions and investigations relating to issues of anti-corruption, anti-bribery, anti-money laundering, economic fraud and employee misconduct. His expertise includes assisting corporations and their key management in investigations of law enforcement agencies such as CBI, ED, DRI, etc. Mohit has been involved in India-related investigations of Italy, France, Brazil, the UK, the USA, Singapore and Bangladesh. He helps clients effectively deal with arrest warrants, look-out circulars, Interpol red corner notices, and requests made under MLAT, Extradition Treaties, UNCAC, and Reciprocity of Assurance. On the arbitration front, Mohit is currently leading multiple domestic and international arbitrations, including an arbitration relating to the construction of a World Bank (IBRD) funded hydroelectricity power project for claims over USD 70 million. Mohit represents some of India’s largest civil construction companies in their infrastructure and construction arbitrations. He has also advised on investment arbitrations under bilateral investment treaties involving India, Libya, Mauritius, Singapore, and Bangladesh.
