We are pleased to offer issue number one of the IBA Maritime and Transport Law Committee Newsletter for 2024.
You will be pleased to note that this issue contains a plethora of articles, including: the effect of sanctions imposed on Russia concerning the 'shadow-fleet' and the environment; the effect of Russian sanctions on Russian marine insurers; a review of the English Supreme Court's decision in 'The Polar' and its impact on the general average for piracy; and a Danish perspective on the European Union's Emissions Trading System; as well as recent developments in Philippine Maritime Law concerning the recent amendment of the Public Service Act.
Based on the insightful questions asked during the panel presentations at last year's Annual Meeting in Paris, we have posed a general question to all members concerning public policy exceptions to international conventions and treaties. We are pleased to share the responses we received from the following jurisdictions (in alphabetical order): Brazil, India, Korea, Norway, Singapore and the United States. Given this response, we plan to include another global survey in issue number two. Accordingly, please keep your questions to the panellists coming – they may end up as a survey question.
We have also included a brief report from our Co-Chairs, Ulla von Weissenberg and Henrik Hagberg, and the always popular 'Meet the Officer' interview, this issue, by Co-Vice Chair, Thomas (Tom) Belknap. Moreover, in advance their efforts, we want to recognise the Arnecke Sibeth Dabelstein Firm (especially Marco Remiorz, Senior Co-Vice Chair), as well as Ahlers & Vogel; Clyde & Co; Corvel; Fleet Hamburg; Lebuhn & Puchta; Schackow; Segelken & Suchopar; and SKW Schwarz for all their contributions of time and treasure towards making the Hamburg committee meeting a success.
We remind all that this newsletter serves to supplement our in-person meetings at the IBA general meetings and the Committee's biennial meetings. In other words, please do not hesitate to submit your articles for the next issue in advance of the Annual Meeting in Mexico City.
