From the Editors – Construction Law International – July 2026

Dear readers,

We are delighted to introduce the July 2026 issue of Construction Law International (CLInt). As we continue our tenure as Committee Editor and Deputy Committee Editor, we remain privileged to collaborate with an editorial board of exceptional calibre: Thayananthan Baskaran (Chair), Ibrahim Abdullah Al-Hammad, Paula Sanchez, Anamaria Popescu, Basil Thevignot, Naoki Iguchi, Khalifah Al-Yaqout, Engy Serag, Sung Hyun Hwang, Jacob Henriquez and Ngo-Martins Okonmah.

Our mission remains to provide a global forum for the most pressing developments in construction law. This issue is particularly diverse, reflecting the rapid legislative and judicial evolution across multiple jurisdictions. We have an in-depth analysis of the United Arab Emirates’ new Civil Code, which entered into force in June 2026, introducing fundamental reforms to pre-contractual duties, limitation of liability, and the regulation of muqawala contracts. From the United Kingdom, an analysis of the Supreme Court’s ruling in Providence v Hexagon on termination for repeated defaults under Joint Contract Tribunal (JCT) forms.

Further afield, our ‘FIDIC Around the World’ series focuses on Ghana. From India, we feature an analysis of the validity of supplementary agreements and the judicial treatment of economic duress in construction disputes. We also look at the Central and Eastern Europe (CEE) region, specifically commenting on the 2025 Polish Chamber of Commerce Arbitration Rules and their impact on regional efficiency.

We include a provocative piece on the ‘evidentiary inflation’ crisis in arbitration, arguing that tribunals should take greater institutional responsibility for curating the record. Complementing this is a technical article on the complexities of causation in claims for prolongation costs.

This edition is rounded off by the review of the comprehensive book Major Issues in International Construction Law.
